It is someone in the Department of Homeland Security (DHS), but it appears that he or she, or them, are in a deeply divided DHS, a DHS swarming with Deep State saboteurs from #TheResistance. Not too long ago this writer suggested that The Resistance, led by Kirstjen Nielsen, is deliberately sabotaging immigration enforcement by withholding relevant information essential for successful immigration enforcement, especially at the border and the new surge of minors, families, and other fraudulent asylum applicants. Ostensibly Homan is scheduled to retire this month, but President Donald John Trump hinted that retirement might not be an option for Homan, duty may call this man again to the colors. Nielsen though appears to be on the way out, hopefully.
These hardliners feel that Department of Homeland Security Secretary Kirstjen Nielsen, a close ally of White House chief of staff John Kelly, isn’t being creative or tough enough in using executive authority to carry out the president’s immigration agenda.
“From my conversations with many officials, both career and appointed, it is apparent that they are concerned about the lack of progress in curbing these illegal entries and making the system work, and their efforts and ideas have been ignored,” said Jessica Vaughan, policy director at the Center for Immigration Studies, a group that favors lower levels of immigration.

Couple this with some patriots in U.S. Customs and Border Protection (CBP) who have attempted to support President Trump by using aggressive enforcement action at the border against the flood of fraudulent asylum claims at Ports-of-Entry (POE). In this case, CBP stationed Customs and Border Protection Officers (CBPO) exactly on the international border, this time on a bridge over the Rio Grande, in an effort to keep out the Caravanners of Death To America By Demographic Displacement.
As the temperature reached 105 degrees, three Guatemalans made their way north Saturday on the Paso del Norte Bridge linking El Paso and Ciudad Juárez, Mexico, seeking to claim asylum in the United States. On previous attempts over the past day, they had been met at the long bridge’s apex by Customs and Border Protection agents—a highly unusual tactic—who asked them for identification and told them they couldn’t proceed to the port of entry because the holding cells were at capacity.
This time, the three migrants—a badly sunburned woman, her baby, and a 16-year-old girl who was not related to them—were accompanied by two representatives of Annunciation House, an El Paso organization that has helped migrants and refugees for more than four decades. Once again, they were stopped by two CBP agents, asked for documents, and told they would not be allowed to go further into the United States because of capacity issues. So began a tense standoff Saturday that marks an escalation in U.S. tactics to keep immigrants out of the country—including those legally entitled to enter and seek asylum—and relieve crowded immigration facilities that officials say are filled beyond capacity.

This is precisely one of the innovative tactics this writer recommended, stationing officers on the border line at POEs and prohibiting aliens without the proper entry documents from presenting themselves at the POE to claim asylum. An alternative to these scammers was offered, they would be referred to American diplomatic posts in Mexico where they could apply for refugee status.
Now many will claim that refusing an alien access to the POE is illegal, as aliens who arrive at POEs are authorized to apply for asylum. The article makes that suggestion as well.
Garcia, Levy, and other advocates for migrants say federal law prohibits agents from turning away people who say they want to seek asylum, which is a means of legal entry in to the United States. The Immigration and Nationality Act states: “Any alien who is physically present in the United States or who arrives in the United States … irrespective of such alien’s status, may apply for asylum.” The American Immigration Council last year filed a federal lawsuit in California challenging what it said was the Trump administration’s efforts to illegally thwart the efforts of asylum seekers. The case is pending.
However, holding the line at the international boundary line with Mexico, e.g. the border between that which is Mexico and that which is the United States, is not a violation of the Immigration and Nationality Act (INA), as amended. Instead if adheres precisely to the INA. By physically preventing those aliens from entering onto territory of the United States, in this case by preventing them from crossing the border and then walking the distance from the actual border to the physical infrastructure of the POE, the policy is completely legal.
Clearly someone in CBP is not under thrall of the Deep State saboteurs like Nielsen. Sadly though CBP is only doing this hold the line action because it is concerned about the capacity of the holding facilities at the POE. And note, the capacity of the holding facilities is not related to custody space leased by ICE to hold the illegals after they are processed by CBP, then transferred to ICE custody. The reporter, Robert Moore, uncritically accepts the specious and dishonest claim by one of the alien smugglers, Ruben Garcia.
“I know you’re not at capacity. I know that’s what you’ve been instructed to say,” said Ruben Garcia, a 72-year-old who was inspired by Mother Teresa to found Annunciation House in 1976.
And I wonder why Garcia has not been charged with alien smuggling. He is liable for that violation of Title 8 United States Code, Section 1324(a)(1)(A)(i), Alien Smuggling:
A) Any person who—
(i) knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien;
Interestingly enough, Thomas Homan should order his subordinates at ICE SVU to bring charges against Garcia and others involved in aiding the Caravanners of Death.
There is war going on in DHS for the heart and head of the agency. Nielsen appears to be sabotaging President Trump. Time for President Trump to act to purge DHS of The Resistance.
He could also solve the problem by informing Mexico that the POEs on the land border will be closed to Mexican citizens with non-immigrant visas, e.g. visitor’s visas for business or pleasure, so long as Mexico allows third country nationals to enter into Mexico, cross Mexican territory, and then attempt to enter the United States.
This problem can be solved by executive vigor, but President Trump is not getting the support and advice he needs from his very appointees. Time for Nielsen to go!
