Time To Arrest Gavin Newsom

The State of California is again breaking U.S. immigration law.  The Governor of California, Gavin Newsom, once a moderate in San Francisco politics with an appeal to the white and Asian middle class of financial interests downtown and the entrepreneurs of the burgeoning restaurant, retail, and bar industry, has gone radical left.  It is illegal to provide any benefit to illegal aliens from the public purse because that encourages illegal aliens to remain in the United States.  This is from Title 8 United States Code (USC) Section 1324, Bringing In and Harboring Certain Aliens.  Other than immediate emergency care, there is no debate over the legality, while technically emergency care would be covered, but that is not an issue, since that is not the main attraction for illegal aliens, but routine care is a major benefit that illegal aliens come to the United States for.  Not just in emergency rooms of hospitals, but even the Federal government, the Department of Health and Human Services (HHS) funds a large and growing number of outpatient clinics and surgeries that cater to mostly illegal and legal aliens.  This is funded either through community grants directly to providers or to State agencies as the pass through, or directly through Medicaid.  These services, other than immediate real emergencies, are what lawyers call an attractive nuisance, which was the purpose of 8 USC 1324, to end the attractive nuisance of benefits for illegal aliens.  Earlier last year Governor Newsom added young adult illegal aliens to the California Medicaid program called Medi-Cal.

Now Newsom has added illegal aliens over age 65 to free Medi-Cal services, which will cost over $100 million.  Remember, while California claims they are the ones paying for this, California can only afford this because the Federal taxpayer is subsidizing the rest of California’s vast budget for welfare which has not declined much during the current economic boom.  This is because California cheats the system by over-counting the poor for determination of Federal aid.

Last year, California became the first state to offer full health benefits to low-income adults 25 and younger living in the country illegally. They also began taxing people who refused to buy health insurance, using the money to help pay health insurance premiums for middle-income families.

This year, lawmakers are aiming to offer benefits to people 65 and older living in the country illegally. Democratic state Sen. Maria Elena Durazo said Newsom promised her he would include the health care proposal for seniors in this year’s budget.

“We don’t have any reason to think it won’t be in there,” she said. “We can’t solve the health care crisis if we don’t include t hem as part of the many Californians who are uninsured.”

The plan, if included in the budget, would continue to put California at odds with the federal government’s immigration policies. It would also likely influence the Democratic presidential nomination. California voters will vote on a Democratic presidential nominee in March.

It cost the state about $98 million to cover full health benefits for low-income adults ages 25 and younger living in the country illegally. State officials about 90,000 people will get coverage.

The proposal for seniors would cover fewer people, about 25,000, but would cost more: About $100 million for a full year, according to estimates of similar proposals last year. That’s because health care for older people is generally more expensive.

The Federal government should take a two-prong strategy on this issue.  It should first have the Department of Justice (DOJ) bring the issue to Federal court and obtain an injunction against implementation of the law and second, it should begin immediately to either subpoena or seize by a search warrant current records held by the State of California Medi-Cal program regarding illegal aliens.  There are plenty of new Judges in the 9th Circuit, so the chance of an injunction succeeding is good.  But even easier because it is purely administrative is for ICE SVU to serve an administrative subpoena on the State of California or obtain a subpoena from a Grand Jury.  I would prefer the Grand Jury route, as defiance of an administrative subpoena is easier for the State of California.  With a Grand Jury subpoena, if the State fails to provide the records, usually in two weeks, a judge is required to take action, usually the arrest of the Custodian of Record for the subpoenaed organization, in this case would be Richard Figueroa, Acting Director of the Department of Health Care Services (DHCS).  Of course, ICE SVU and the DOJ have to chose the right judge in the Central District of California, which would not be hard.  The Central District of California is also the most Republican.

But the primary intent should be criminal prosecution of Figueroa and Gavin Newsom for the crime of aiding and abetting illegal aliens.  It is time for Stephen Miller and Ken The Knife to take action this day!  Time to arrest the responsible California official for aiding illegal aliens, Gavin Newsom.
