It should be no surprise that the Biden Regime Administrative Amnesty is adding to the backlog in the Executive Office For Immigration Review (EOIR), but there is somewhat of a surprise, it is only one million, while the number of illegal aliens that have entered the United is over 5.5 million.
Almost 800,000 people are waiting on asylum hearings, which typically take 1,572 days or 4.3 years[.]
The Border Patrol had more than 2.2 million encounters with illegal crossers between ports of entry on the Southwest border in fiscal 2022.
A recent report from the DHS Inspector General indicates that most of the illegal crossers are not put in detention facilities or expelled under Title 42, but rather are processed for outcomes allowing them to be released into the United States to wait for immigration hearings. This has overwhelmed the immigration courts.
The immigration court backlog was 1,262,765 cases at the end of fiscal 2020, which was the last full fiscal year of the previous administration. Under the current administration, it has risen to 2,023,441 cases as of the end of November 2022.Biden’s Border Crisis: Our Immigration Courts Have A 2,023,441 Case Backlog And It’s More Than We Can Handle, by Nolan Rappaport, Fox News, January 2, 2022
Some of the 5.5 million not in removal proceedings are in the administrative asylum process.
Almost 800,000 of them have submitted asylum applications and are waiting for an asylum hearing. The average wait from when an application is filed to when an applicant’s case will be heard is 1,572 days, or 4.3 years.
Most of those applications are likely to be approved by Deep State leftists, the Asylum Officer cadre, working in U.S. Citizenship and Immigration Services.
More of the 5.5 million were released into the United States on parole or with a Notice To Report (NTR), many of those have just disappeared knowing that their asylum claims are fraudulent.
But there is a solution, implement, expand, and mandate the use of Expedited Removal (ER). ER is the administrative deportation authority held by the Department of Homeland Security (DHS) and provided by the Illegal Immigration Reform and Immigrant Responsibility Act of 1996. Currently the Biden Regime is not implementing ER on the millions that are flooding the border. Congress should expand and mandate use of ER to end the current crisis at the border.
