One of the most prominent Jewish public intellectuals, one half of the Krassenstein brothers, Brian Krassenstein, has denied there is a crisis at the border, though claiming that there is an ongoing crisis at the border that has spanned decades. The kids today call it gaslighting, but I call it lying, but many will call it chutzpah. The Krassenstein brothers rose to a very curious prominence during the Trump Administration after settling internet fraud allegations with the Department of Justice (DOJ) by surrendering over $450,000.00 in assets. At the same time that the Krassensteins refused to cooperate with Federal investigators, X, then Twitter, and Jack Dorsey promoted the two as the primary response by X to Donald Trump’s X account. Either of the brothers were the pinned response to Trump’s Xs. No reason was given by X or Dorsey for the Krassenstein prominence and special treatment, but the obvious answer is that there was collusion between X, Dorsey, and the Krassensteins. As leaders of the Resistance, the Krassensteins were promoters of various lies perpetrated by the media against Trump, including the Russia Hoax.
However, Brian Krassenstein has reinvented himself as the voice of moderation and solutions, while toadying for Joe Biden. Nowhere is this more blatant than on the border crisis. Krassenstein has a new X out about how there is no problem at the border and it isn’t Joe Biden’s fault. It is merely a long-standing problem or a problem of recent unexplained events in Venezuela. One or the other, Krassenstein does not explain.
Once the king of sketchy investments, Krassenstein portrays himself now as an expert in Artificial Intelligence and a Political Journalist. Big change. But in this X he is now an expert in immigration law, immigration enforcement procedure, and international law. A regular Renaissance man.
However, his international law, immigration law, and immigration law enforcement procedure knowledge is close to nothing and that is being generous, but let us deal with his claims, contradictory as they are, one-by-one.
Whether you are a random person on X or Elon Musk, I urge you all to please read this post and stop using videos like this one to claim that Biden has an “open border policy”:
#1) The people in this video are already on American soil. The agents have a few options here. Detain them behind the razor wire or detain them in front of it, let the children cut themselves on razor wire or make sure they don’t get cut.
#2) In May President Biden issued an “asylum ban” which barred migrants from applying for humanitarian protection if they cross the border against the law or fail to first apply for safe harbor while crossing through another country on the way to the U.S. The US COURTS OVERTURNED IT. Biden also requested $3.5B for more border patrol agents and judges and lawyers. Republicans refused.
#3) Let me explain to you all why the people in this video can’t simply be put on a truck and driven back into Mexico and dropped off:
a – They have a right to due process according to our Constitution.
b – There are international laws indicating that we can’t just drop people off from Honduras or Cuba or any other nation into Mexico. What if one of these people claimed they were from Canada? Should we drop them in Canada?
c – How do we immediately prove that a person is not an American, or an Italian, or a Brazilian if they claim they are?
Stop pretending that Biden isn’t doing anything. Stop pretending that the immigration problem is simple. Stop pretending that this has not been a problem for decades.
Understand that the surge of migrants isn’t the fault of Biden but actually global geopolitical upheaval in Cuba, Nicaragua, Venezuela and other nations. Instead of pointing fingers and claiming that “Biden has an open border policy,” when his policy is not much different than those we have had for the last 40 years, how about working together on comprehensive reform?
So before you make another Tweet claiming Biden has an Open Border Policy, how about instead you provide actual solutions that are LEGAL, that should be implemented.

As an expert, rather than someone he describes as a random person, I will address each claim in turn. First, let us deal with the video he attached to his X, claiming that the video did not prove that the border is wide open.
The video is from alien smuggling action by the now infamous Concertina Wire Agent (CWA), a U.S. Border Patrol (USBP), Border Patrol Agent (BPA), likely assigned to the Border Patrol Tactical Unit (BORTAC). Krassenstein says this is not evidence of an open borders policy. That is certainly an example of chutzpah. The video is presenting an incident that proves the exact opposite of what he claims.
Given my 28 hears with the legacy Immigration and Naturalization Service (INS) and the Department of Homeland Security (DHS), cutting a fence to allow illegal aliens to enter would never have happened prior to the Biden Regime; opening gates and cutting fencing to allow illegal aliens into the United States is unique to Joe Biden and his Open Border Policy. Never before in history has this happened, and now it’s a daily occurence.
Also unique to this incident is that CWA was being cheered on by a uniformed cadre of open borders advocates present in the yellow t-shirts. I don’t know which group this is, but this is a first for the Border Patrol, cooperating with alien smuggling groups. More importantly though, before the Biden Open Borders Policy, illegal aliens caught at the border were arrested and handcuffed.
Instead the illegal aliens in this video were not detained nor not questioned as to their citizenship and right to enter or remain in the United States as is the proper procedure when a Border Patrol Agent encounters an alien at the border, but allowed to continue on their merry way with no action by CWA. In other cases Border Patrol Agents were not merely letting the illegal aliens continue on their way, but giving them a fist-bump.
It is proper procedure to detain and handcuff an alien, not release them to wander onward, but then Krassenstein would not know that as he knows nothing about immigration law enforcement!
But worse for Krassenstein, even Democrats are admitting that the border is open. New York Governor Kathy Hochul has admitted the border is open.
And here is a gate opened in the border fence that proves the Biden Open Borders Policy:
But let us compare border arrests from President Trump’s time in charge:
The Biden years show annual increasing arrests since he took office, an Open Borders Policy in effect, with the citation.
So, strike one for Krassenstein, he beclowned himself in his first sentence. And the chutzpah only gets worse. We go to his point 1, which is rather strange, detain the illegals behind or in front of the wire. Clearly Krassenstein doesn’t know the first thing about border fences and arrests.
Krassenstein presents a false dichotomy, either arrest in front of or behind the barbed wire fence, both are wrongly presented; detaining them “behind” by which I think he means leave them on the other-side of the concertina wire, the border fence, is perfectly acceptable. Illegal aliens on the other side of a border fence are generally allowed to stay there or are pushed back by use of force, such as pepper ball guns, tear gas, or baton charges.
An alien on the other side of the border fence is not an imperative for agents as they are on the other side. Nor are they an imperative to let into the United States. Krassenstein does not know that most border fencing is not built on the border demarcation line, but within the territory of the United States, as for building and maintenance access to the other side is required. If it were on the demarcation line, construction and repair personnel could not fully access the fence, as one side would be in Mexico. Aliens who cross the demarcation line and approach border fencing are generally just monitored to see if they attempt to climb the fence or take destructive action against the fencing.
The other option is not detain them in front of the concertina wire, by which I think Krassenstein means arrest them on the other side of the wire, but they aren’t on the other-side of the wire, they must first be assisted in crossing the border fence. That is not an option. Assisting an alien to cross a border fence is a crime, a violation of Title 8 United States Code Section 1324, Bringing In Or Harboring Certain Aliens. Barriers like fencing and concertina wire are used to keep illegal aliens out. A Border Patrol Agent would never cut a regular fence built by the U.S. government to let in an alien, but the Biden Open Borders Policy allows for the concertina wire built by the State of Texas to be cut to let in illegal aliens.
Then we have the shameless baby waving, this time with abused children being forced to crawl through the barbed wire.
The children are not crawling through barbed wire to flee from oppression in Venezuela, but are being forced through by their parents in an effort to enter the United States taking advantage of the Biden Open Borders Policy of employment and welfare for illegals.
And Krassenstein does not even address the most obvious alternative to his false alternatives, push-back. Push-back is the tactic of forcing illegal aliens away from border barriers and even back across the Rio Grande through force or threat of force. That is an other option, as well as blocking them at the border, including in the Rio Grande. Fences exist to close borders, not open the borders.
Krassenstein appears to know nothing about the border or enforcement procedure. But he does have opinions, ill-informed opinions. So, second sentence, and we have another Krassenstein failure.
In point 2, Krassenstein makes much about the fake Biden changes to asylum, with a judge blocking the changes that it is more than likely that the Biden Regime had no intention of implementing, just as it failed to implement Expedited Removal at the border when Title 42 authority was ended by Biden, which opened the borders! Then we get the claim that Biden requested $3.8 billion for more Border Patrol Agents and judges, but obviously not for the border fence that Biden ordered an end to construction of. Can we take anyone seriously who says we should spend money on processing illegal aliens and not blocking them with a steel border fence? Obviously not.
Then Krassenstein claimed the Republicans did nothing. Well, they did pass House Bill 29, which would have ended catch-and-release, imposed Remain-In-Mexico on the Biden Regime, and imposed the limits on asylum that Biden ordered administratively. But in another example of chutzpah, Krassenstein ignores the Republican solution to the Biden Open Borders Policy. Another fail. And point 3 is not going to go Krassenstein’s way either. In this point, in three parts, he claims that we can’t just put them on trucks and driven back to Mexico. I’ll fact check that: and it’s a big false!
Yes, under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRAIRA) the Border Patrol can do exactly that. Well, they don’t go on trucks, but on buses, and they get dropped of at the Port-of-Entry (POE) where they walk back to Mexico through the border gate.
IIRAIRA provides for Expedited Removal of illegal aliens without review by the Executive Office For Immigration Review (EOIR), the immigration court system, which the Biden Regime has ignored since Biden entered office and after the end of Title 42. So, yes, aliens who fail their credible fear interview can be removed immediately without appeals. Expedited Removal is the due process that illegal aliens get.
The Biden Regime is not using Expedited Removal, as they want as many illegal aliens in the United States as they can get for their political purpose, White Replacement and electing a new people through an Open Borders Policy!
Aliens who pass a credible fear screening are then supposed to be returned to Mexico to await their EOIR hearing as required by the Immigration and Nationality Act. That is their due process.
Krassenstein fails on his appeal to the Constitution and due process. He is not doing well.
Point 3b is a claim that we can’t deport illegal aliens from third countries to Mexico. Again, Krassenstein is just either wrong or lying. Krassenstein, the investor and AI expert, just does not know anything about international law or immigration law for certain, but is he lying? I don’t know. Did he do any research for his X?
In fact, Mexico accepts back third-country illegal aliens, it even has an unwritten understanding with the United States that it will accept back a number that varies according to political events. In any event, the United States can just send all of them back to Mexico and there is nothing Mexico can do, as the United States holds leverage over Mexico, not the other way. Remember when President Trump threatened to end access to the United States by Mexican exports? Mexico folded like a cheap suit and allowed Remain-In-Mexico for third-nation aliens. And yes, if one of them claims to be Canadian, then they get deported to Mexico. That is the law and policy. If you enter the United States from Mexico, that is where you get deported to. Though I am curious as to why a Canadian would enter illegally into the United States from Mexico. Why not from Canada? Just shows how ignorant Krassenstein is.
What he is getting at, though I am not certain, is the principal in international law relating to aliens claiming asylum, non-refoulement. Non-refoulement is the practice in law that aliens claiming asylum should not be returned without due investigation to the nation of which they are fleeing, which would be Mexico for third-country nationals illegally entering the United States. Technically non-refoulement is not an issue because the illegals are not fleeing Mexico, but their home country. For future reference, I am offering in good faith, if Krassenstein is serious about solutions, the opportunity to run his ruminations on immigration law and policy by me before he publishes.
Another fail in a long list for Krassenstein.
Then we come to his irrelevant point 3c about how does the government of the United States make a determination of citizenship of alien arrested at the border. “c – How do we immediately prove that a person is not an American, or an Italian, or a Brazilian if they claim they are?”
I am uncertain why he makes this point. The USBP has been doing that for longer than Krassenstein has been alive. There is a special procedure for dealing with false claims to U.S. citizenship by aliens.
There are also procedures for establishing an alien’s identity and citizenship. Most aliens crossing the border are Mexicans, at least in the past, but not now with the Biden Open Borders Policy. In the past, most Mexicans came across illegally with their Mexican identity papers, usually a Mexican voter registration card which is the de facto national identification card in Mexico, though during my time in the INS, Mexican males had to carry their draft card with them at all times and we used that as well. Generally determining citizenship was not an issue.
Now, most crossing the border are not Mexican, but third-country nationals and in numbers so huge and unusual they are obviously responding to the Biden Open Borders Policy. These third-country nationals usually destroy or abandon their passports or other identity papers. But it does not matter so much their citizenship as much as they are aliens, which is the most important legal fact that needs to be established for the alien to be deported, especially after an entry over the land border, as deportation to Mexico is the lawful policy. In any event, most admit their nationality, which is essential for any fraudulent asylum claim.
After these failed points, Krassenstein then claims Biden isn’t doing nothing on the border. Well, no one claimed he was doing nothing, we are documenting that he has an Open Borders Policy, which is readily apparent from the record monthly numbers of illegal entries!
It is so bad that BPAs are not patrolling the border, but merely processing those illegal aliens who turn themselves in because of the catch-and-release policy of the Biden Open Borders Policy!
He is doing something, something evil!
Then we get more chutzpah, it isn’t Biden’s fault, it’s been going on for decades, things are happening in Cuba, Venezuela, Nicaragua, and Haiti! That does not explain the Chinese, Indians, Arabs, and Africans. Nor is it credible, as we know that Remain-In-Mexico solved the problem under the Trump Administration. Biden opened the borders, that is a fact. If Biden had kept the Trump policies in effect, there would not be record monthly numbers of illegal aliens crossing the border! Let’s not get stuck on stupid!
Then we get the “Why can’t we all get along” chutzpah and work to find solutions together? Well, Krassenstein, we had solutions; Expedited Removal, detention, Remain-In-Mexico, and political pressure on Mexico. Those worked. What is your solution? Why don’t you get behind custody, pressure on Mexico, Remain-In-Mexico, and Expedited Removal?
Krassenstein is further disingenuous when he asks for legal solutions, well the legal solutions are in the statutes; Expedited Removal, Remain-In-Mexico, and custody.
Krassenstein doesn’t get behind the proven solutions because he supports open borders, he supports the Biden Open Borders Policy. Krassenstein hates America and the White majority of Americans and wants us replaced with non-Whites from the Third World. That is his chutzpah, claiming he is opposed to Open Borders, but offering no solutions except trust Joe Biden and the readily apparent Open Borders Policy. Don’t piss on me and tell me it’s raining. That is chutzpah! Or in English, lies!
